Texas Gov. Greg Abbott ordered TCEQ to stop all data-center environmental permits until ERCOT finishes its grid waitlist audit, expanding August’s interconnection pause as the AI data-center buildout becomes midterm politics.
Texas Gov. Greg Abbott on Monday ordered the Texas Commission on Environmental Quality to halt all data center-related environmental permits until the Electric Reliability Council of Texas completes an audit of the existing waitlist for data centers seeking to connect to the state grid, CNBC reported.
The audits were originally ordered in August, when Abbott also imposed a moratorium on new data-center grid approvals. Monday’s directive expands that freeze from interconnection approvals into environmental permitting at TCEQ. AI Tech Daily covered the August grid-hookup pause when it first landed.
Texas was on track to surpass Virginia as the world’s largest data-center market by the end of the decade, according to a February JLL report cited by CNBC, but the new environmental-permit halt may slow that path. Data centers have become a breakout issue in the 2026 midterms. A recent NBC News poll found 64% of Americans would be less likely to vote for a candidate who “supports building local data centers.”
Abbott is in a tight race for a fourth term against state Rep. Gina Hinojosa and has had to reverse course from his 2025 claim that Texas — with sales-tax exemptions for qualifying data centers and high-profile projects such as OpenAI’s Stargate — would be the “epicenter of AI development.” The press release for the earlier moratorium said that next session the governor will work with the Legislature to eliminate any financial incentives for data centers.
TCEQ is expected to update the governor’s office on compliance with Monday’s directive by October 19.
